Were you aware that a suitably qualified independent BASIS agronomist who is trained in environmental management can authorise use of pesticides on ELS options? Where the derogation does not involve the use of pesticides, other farm conservation advisers may sign the derogation notice.
A derogation is for a 'one-off' task, eg permission to control serious weed infestations using herbicides, and does not last for management over a period of time. Another important consideration is that you are normally only allowed up to 3 derogations over the term of the 5-year agreement.
In order to seek a derogation, you should complete a derogation notice form from Defra (can be downloaded from http://www.defra.gov.uk/corporate/regulat/forms/erdp/es/erdpelsoels2.htm).
